Rutland Telecom Terms and Conditions for domain/email hosting, registration and transfers

GENERAL TERMS You agree to indemnify, defend and hold Rutland Telecom Ltd (The Company), and its respective officers, directors, owners, agents, hosting company, information providers and licensors (collectively, the "Indemnified Parties") harmless from and against any and all claims, liability, losses, costs and expenses (including legal fees) incurred by any Indemnified Party in connection with any breach by you of these terms and conditions. The Company. reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with the Company's defence of such claim. This agreement shall be governed by, construed and enforced in accordance with the laws of England and Wales and the courts of England and Wales shall have non-exhaustive jurisdiction in actions brought by you, any third party or the Company. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by the Company. or displayed on its website. The Company may at any time revise these terms and conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current terms and conditions to which you are bound. By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions. Your virtual server (inc FTP and Telnet access) is for your personal use, or the use of your business only. You may not sub-host web pages for other individuals, businesses or entities on your named account. You must not divulge your FTP/account password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people. We cannot accept liability for FTP uploads of content to your website. The standard webspace allocated to each account is 50MB and additional space is available on request. You may not store more data in your account than your allotted virtual server space. Email hosting includes 50MB of space and up to 5 POP3 email addresses. Combined website and email hosting = 100MB. Charges apply for exceeding your virtual server space or email space at a rate of £1 + VAT per MB per year or part thereof. Data is stored on the Company servers is not backed up. It is recommended that you keep an independent backup of all data (including emails) stored on the server. We cannot accept liability for lost or corrupted data held on our servers. Downtime on our internet servers is kept to a minimum and has averaged at under 0.001% over the last 4 years. You may not run server processes (eg. talkers/IRC Bots). The Company shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services. When your account is closed, all files (including web pages, etc.) will be deleted. We reserve the right to cancel your account at any time if, in the reasonable opinion of the Directors of the Company, you have misused your account. Under these circumstances we would refund your annual hosting fees on a pro-rata basis subject to an administration charge equivalent to 1 hour at our standard hourly labour rate Where clients are significantly overdue with payment for invoices for work related to domain names and website design, the Company reserves the right to deny FTP access and if necessary remove client websites from our servers. A warning will be issued prior to temporary deletion of a website and the Company accepts no liability for loss of data or loss of business under such circumstances. To protect your privacy we never distribute your name or e-mail address to any third parties without your prior approval. Users must not participate in any form of un-solicited bulk e-mailing or spam. If your account is closed we will remove all your personal details held in electronic format from our records. REFUNDS Hosting accounts are available on a minimum basis of 1 year (minimum term contract 12 months). If you cancel your account within your service period then the Company will not make any refunds on any unused portions of your account. Domain registration is charged in minimum periods of 2 years If you place your order by telephone or over the internet, and are not satisfied with our level of service, you are entitled to make use of our 7 day money back guarantee (distance selling regulation) but this excludes the refund of any domain name registration fees or transfer fees and our administration fee. HOSTING & BANDWIDTH CHARGES If your bandwidth reaches the point where it has an adverse affect on other clients sharing the same server, we reserve the right to disable your site until you can reduce your bandwidth usage. Each virtual server includes 1GB/month of bandwidth. If you use more than this amount then you agree to pay for this extra bandwidth at a rate of 10p (ten pence) per 1 MB + VAT. Only a very small proportion of our clients exceed their bandwidth allocation. Discounts are available for high bandwidth users. There is a 5MB limit per email on the size of email attachments which can be received to pop3 accounts (or sent from webmail). Webmail accounts limit attachment size to 2MB. Hosting charges are displayed on our website. Charges applicable at the time of hosting renewal apply for 12 months irrespective of any price changes during the relevant period. Charges applicable for domain registrations apply for the duration a domain is registered for irrespective of any subsequent price increases during the relevant period. SMTPWe provide an SMTP facility for PC-based email clients. WEB PAGES Commercial use of web and ftp space is permitted. You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK or International law. You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s). We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. The Company does not allow adult, violent or illegal MP3 web sites on its servers and reserves the right to remove any content it regards as unsuitable. CREDIT Credit accounts are available for government, health, education and councils only. If your account/service is activated before payment is made then payment must be sent in full by return. If payment is not made in full within 30 days your account may be deactivated. Credit for other businesses or individuals is by negotiation. FEES for TRANSFERS & CHANGES No administration charge is made to register a domain but an administration charge equivalent to 1 hour of our current support charging structure is made for any changes to:
